Notes for: Ezekiel FOSGATE

Ezekiel applied for a pension on 30 Aug 1823 aged 88 years as a resident of Fishkill, Dutchess Co, NY for his Revolutionary War Srvice. It was denied because he could not prove it and did not have discharge papers. After the close of the war he moved from his home in Marlborough, MA to a place then called Warren's Bush in Montgomery Co, NY. He then moved to a place called Woodstock about 10 miles from Kingston where he remained for nearly 4 years. He then moved to the town of Fishkill, Dutchess Co, NY where he remained.

Will of Ezekiel Fosgate of Fishkill, Dutchess Co., NY dated 11 Sept. 1826

It was presented to the Surrogate's Court on 2 July 1833.

I give to my wife Phebe Fosgate all the income of my farm the stock and
use of the farming utensils, house, household furniture and all
appertaining there unto untill Robert Fosgate shall arrive to the age of
twenty-one years that is if she shall remain my widow, if not I give her
no more than one third part of my estate during her natural life and I
further order that if my wife Phebe Fosgate should die before my youngest
child shall come to the age of twenty-one years I order that my estate
shall not be sold until my youngest child shall come to the age of
twenty-one years at which time I direct my executors to sell my whole
estate and divide it agreeable to the following legacies:
To my eldest son Bela Fosgate I have given what I intend he shall have.
To my eldest daughter Gratia Ray I give [ ] dollars after the death of
my present wife Phebe Fosgate.
To my son Ezekiel Fosgate I have also given what I intend he shall have.
To my son Josiah Fosgate I give twenty dollars and all my wearing
apparel after my decease.
These four children are by my former wife.
Polina Lawrence (?), Ruth Fosgate, Moriah Fosgate, Catherine Fosgate,
Sarah Fosgate, Joel Fosgate and Robert Fosgate are all to share equally
after the decease of their mother Phebe Fosgate and lastly I nominate
constitute and appoint my wife Phebe Fosgate and Peter D. Fowler.
