His father Robert, gave his homestead farm to Joel which was somewhat encumbered. Joel was feeble in his youth, but became strong and endured immense labor on the farm and in the brickyard at the foot of "Clay Pit Hill". Joel Fosgate made his will 23 Oct 1821 and it was filed 17 Apr 1824; his son Luke to be executor. To beloved wife Naomi, all my dwelling house with cellar under it (except the Easterly front room), my old barn so called with half of all my other buildings except the new barn so called, also half of all my lands. Also all my household furniture except my desk. 2 cows, 1 swine and half of all provisions. Also to be furnished with a horse and chaise whenever she wishes. Furniture undisposed of is to be divided among my 5 daughters.
To son Robert, my wearing apparel and $100 and all his debts to me to be cancelled.
To son Mendall $20.
To son Joel Jr my desk and $200.
To dau Betsey Spafford $100.
To dau Sally Puffer $100.
To dau Sophia Maynard $100
To dau Susanna Brigham $100
To dau Lucy $300 ($200 if she married before 7 years and $100 after). She shall be accommodated with suitable house room and enough firewood as long as single.
To son Luke everything else after debts and burial expenses of me and my wife.
